Denied at Hearing
Don't be discouraged. You have 60 days to appeal. The next step is to file a Request for Review before the Appeals Council. The Appeals Council involves a review of the record completed by the Administrative Law Judge (ALJ). This includes all of the evidence and testimony. A written decision will be issued by the Appeals Council. This written decision can take from 6-24 months. The Appeals Council can reverse the ALJ decision and award benefits (this is very rare), can remand to the ALJ for additional proceedings, or can deny review. If review is denied, the next step is to file a civil complaint in Federal District Court.
